Jill the Travel Gal LLC Terms and Conditions

 

These terms and conditions ("Terms and Conditions") establish the relationship between Jill the Travel Gal LLC doing business as Jill the Travel Gal LLC ( "Jill the Travel Gal", "we," "us" or "our"), and you, the purchaser and/or traveler ("Client," "passenger," or "you/your"). By arranging travel with Jill the Travel Gal, you agree to abide by these terms and acknowledge that Jill the Travel Gal acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors offering accommodations, transportation, and other services ("Suppliers"). Jill the Travel Gal is not the originator or provider of the travel services. These terms include warranties, disclaimers, and exclusions of liability, and they may limit your rights and remedies while providing protection to Jill the Travel Gal.

 

USE OF JILL THE TRAVEL GAL SERVICES, ACCESS, AND INFORMATION FOR TRAVEL BOOKINGS

By using Jill the Travel Gal services, accessing our platform, and making travel bookings, you affirm that you are at least 18 years old and possess the legal authority to enter into this Agreement and arrange travel through Jill the Travel Gal. You accept financial responsibility for all travel bookings made on behalf of yourself and any individuals traveling with you. Furthermore, you guarantee that all information provided by you, whether for yourself, members of your household, or others for whom you have authorization, is accurate and truthful. You agree to make only legitimate reservations or purchases through Jill the Travel Gal and its Suppliers, understanding that any speculative, false, or fraudulent reservations are strictly prohibited.

Jill the Travel Gal acts as an agent for the travel Suppliers listed on your itinerary. Each Supplier will have its own terms and conditions that apply to your reservation and purchase of travel-related goods and services. You acknowledge and agree to comply with the terms and conditions set by any Supplier you have selected as a service provider for your approved itinerary.

PAYMENTS AND CANCELLATIONS

You are solely responsible for all charges, fees, duties, taxes, and assessments associated with your travel bookings through Jill the Travel Gal. By submitting a credit card authorization form to Jill the Travel Gal, you grant permission for us to utilize your chosen payment method to purchase travel products from our Suppliers on your behalf. Unless cases of fraud are involved, it is agreed that you will refrain from initiating any disputes with your bank or credit card company to avoid or violate the booking terms and conditions set by Jill the Travel Gal or its Suppliers. This includes cancellations or changes to your itinerary or arrangements due to circumstances beyond the control of Jill the Travel Gal or its Suppliers. If you attempt to chargeback, reverse, or reclaim a previously authorized payment for your trip, Jill the Travel Gal reserves the right to recover all additional costs, fees, and expenses associated with such actions, including attorney fees.

All travel payments must be made prior to departure, following the terms and conditions specified by each Supplier. It is important to understand that failure to make the final payment or any violation of a Supplier's purchasing conditions may result in the cancellation of your reservations, denial of access to flights, tours, hotels, cruises, or other travel services, or forfeiture of any funds already paid for your reservations. In certain cases, bookings that are made and under deposit may not be eligible for refunds. If you make changes or cancel your travel plans after receiving confirmation of a booking, you may not be entitled to a refund. All cancellation requests must be submitted in writing to Jill the Travel Gal. Cancellation penalties from Jill the Travel Gal and third-party Suppliers will apply accordingly. Cancellation fees will be charged to the credit card or payment method authorized for the payment of travel services, or they will be deducted from the Supplier's refund.

Jill the Travel Gal charges a $100 per person cancellation fee for all trips under $7,500 and $150 per person for trips over $7,500. 

TRAVEL DOCUMENTS, INCLUDING TSA AND DHS ACCEPTABLE IDENTIFICATION REQUIREMENTS

Clients are responsible for obtaining and carrying valid passports, visas, and other required documents according to government regulations. The U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise all travelers, whether domestic or international, to carry acceptable identification for boarding flights. Examples of acceptable identification can be found at http://www.tsa.gov/traveler-information/acceptable-ids, such as a DHS-designated enhanced driver's license, passport, or foreign government passport. It is important that the information on the identification card, including name, date of birth, and gender, matches exactly with the information on airline tickets and booking records. Failure to comply with these requirements may result in denied boarding or delays at security checkpoints, which may cause clients to miss their flights and subsequent travel bookings for cruises and tours.

Upon receiving travel documents, it is your responsibility to carefully review and verify all information for accuracy. If any changes or corrections are needed, please contact Jill the Travel Gal immediately.

Please be aware that certain countries may refuse entry to passengers whose passports expire within six (6) months of the expected return date. Non-U.S. citizens may have additional documentation requirements. If you are traveling with a passport from a country other than the United States, please inform Jill the Travel Gal. We do not have control over visa issuance or visa waiver approvals for your travel. If a visa is not issued, Jill the Travel Gal is not responsible for any payments made towards the planned trip. Keep in mind that the entry and exit requirements of each country can change on a daily basis.

Travel documents are also required for children and infants. If a minor is traveling with only one parent or without both parents, they may be stopped and denied entry unless authenticated and verified consent forms are provided to the authorities. The U.S. Customs and Border Protection Agency requires that groups of children under the age of 19 arriving in the United States by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team may present an original or copy of their birth certificate, Consular Report of Birth Abroad, or Naturalization Certificate. Written consent from parents or legal guardians must be provided to the supervising adult or group leader.

INDIVIDUAL ENTRY AND EXIT REQUIREMENTS

Different countries have varying perspectives on past criminal offenses, whether committed within their borders or elsewhere. If you have a current or previous criminal offense, it is advisable to directly contact the respective country for information on entry and exit requirements. For detailed requirements, you can refer to the US State Department Website at https://travel.state.gov/content/travel.html. Please note that we do not inquire about an individual's criminal record to uphold our clients' privacy. For instance, if you plan to travel to or transit through Canada, individuals with a record of Driving While Intoxicated (DWI) should carefully review the current entry requirements. HAZARDOUS MATERIALS

Passengers are strictly prohibited by federal law from bringing hazardous materials onto aircraft. Violation of this law can result in imprisonment for up to five years and penalties exceeding $250,000 (49 U.S.C. 5124). Hazardous materials encompass explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive materials. Examples include paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals.

There are limited exceptions for small quantities (up to 70 ounces total) of medicinal and toiletry items in the passenger's luggage, as well as certain smoking materials carried on the passenger's person. Passengers should consult the relevant airline representative(s) on their itinerary for further information. INSECTICIDE NOTICE

It is advisable to consult the list of airports provided by the Department of Transportation (DOT) which outlines the countries where airlines are required to apply insecticides in the passenger cabin either before the flight or during the aircraft's operation. This list can be found on the DOT's official website and is periodically updated. You can access it at: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.

HEALTH/IMMUNIZATIONS

Prior to traveling, it is essential to ensure that you have received the necessary immunizations and health screenings and that you possess the required documentation to validate these immunizations and screenings. Jill the Travel Gal does not assume responsibility for the accuracy of health, vaccination, or documentation prior to departure or upon arrival at the final destination. In certain cases, it may be necessary for your healthcare provider to record the required inoculations on an official vaccination certificate, which you must carry as proof of immunization. If you have any concerns regarding medication or specific inoculations, it is advisable to consult with your healthcare provider BEFORE making travel arrangements. For pertinent information regarding travel to specific destinations, please refer to the State Department website at http://travel.state.gov, and for health-related matters concerning travel, visit the Center for Disease Control at http://wwwnc.cdc.gov/travel/.

AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK-IN

Jill the Travel Gal assumes no responsibility for any changes in airline schedules. On rare occasions, when departing from a country, it may be necessary to pay certain departure taxes in cash only, and the prices of these taxes may vary. Failure to utilize a reservation may result in the automatic cancellation of all subsequent and return flights, as well as the forfeiture of airfares.

Airline e-tickets are valid for one year from the date of issue, unless the fare rules specified in the passenger's itinerary indicate otherwise.

To comply with enhanced security measures, it is highly recommended that you check in at least 2 hours prior to the scheduled departure time for domestic flights, and 3 hours prior for international flights. It is also advisable to reconfirm the flight times at least 24 hours in advance for domestic flights and 72 hours in advance for international flights.

RIGHT TO CORRECT ERRORS/OFFERS SUBJECT TO AVAILABILITY

We retain the right to rectify any errors. Should there be any pricing errors or omissions, we reserve the right to modify the prices or make necessary corrections. All offers, incentives, and promotions from suppliers are subject to availability and may be subject to change without prior notice. We recommend that prospective clients make early reservations to avoid disappointment, potential fare increases, and additional fees for late bookings.

UNUSED RESERVATIONS, PASSENGER MINIMUMS, AND CHANGES TO BOOKINGS

Unused travel portions are non-refundable when prices are based on supplier contract rates. Group tours may require a minimum number of passengers, and failing to meet the requirement may result in a surcharge or tour cancellation. Changes to confirmed arrangements can be requested in writing, but certain bookings may not be eligible for changes. The supplier has the authority to make itinerary alterations, including due to severe weather, without liability on our part.

LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE

Jill the Travel Gal acts as a booking agent for disclosed principal Suppliers and does not directly provide travel services. Each Supplier operates independently and is not under the control of Jill the Travel Gal LLC. The Suppliers listed in your travel documentation are the ones responsible for delivering the purchased travel services, and you agree to accept their services.

As Jill the Travel Gal acts as an agent for disclosed principal Suppliers and lacks control over their operations, you acknowledge that Jill the Travel Gal is not liable for any personal injury or property damage arising from these services. Jill the Travel Gal disclaims any liability, whether contractual, tortious, or otherwise, including but not limited to direct, punitive, special, consequential, incidental, or indirect damages related to the goods or services provided by any principal Supplier booked through Jill the Travel Gal. This includes any acts, errors, omissions, injuries, losses, accidents, delays, or irregularities caused by the Supplier's fault, negligence, willful acts, omissions, or any other factors beyond our control. This also includes the Supplier's failure to deliver services fully or adequately, cancellation and refund policies, fuel increases, bankruptcy, cessation of operations, and other matters outside of Jill the Travel Gal's control. By agreeing to this, you release Jill the Travel Gal from any liability regarding these issues.

LIMITATION OF RECOVERY

Jill the Travel Gal has received only commissions and fees for travel transactions, and you understand and agree that any recovery from Jill the Travel Gal will be limited to the amount of commission and fees actually received by Jill the Travel Gal.

RISKS AND SAFETY

Traveling to certain destinations may carry varying levels of risk. Jill the Travel Gal advises clients to stay updated on current news events and review travel prohibitions, warnings, announcements, and advisories issued by the United States Government before making travel arrangements to international destinations. Information regarding health and safety conditions in different countries and the associated travel risks can be found on websites such as http://www.state.govhttp://www.tsa.govhttp://www.dot.govhttp://www.faa.govhttp://www.cdc.gov, and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government, designed for U.S. citizens traveling to or residing in foreign countries. By registering on https://step.state.gov/step/, you can provide details about your upcoming trip abroad, enabling the Department of State to offer better assistance in case of emergencies. It is recommended to register for STEP.

Jill the Travel Gal does not guarantee the advisability or safety of traveling to specific destinations when offering them for sale. Jill the Travel Gal will not be held responsible for any costs, damages, or losses incurred as a result of traveling to such destinations. By participating in the travel arrangements, clients acknowledge and accept the associated risks at their own discretion.

TRAVEL INSURANCE

Jill the Travel Gal provides access to travel insurance as a means to safeguard passengers and their travel investments. Unless explicitly stated otherwise, travel insurance is not included in the cost of the client's itinerary. It offers protection against various risks such as third-party supplier default/bankruptcy, travel delays, interruptions, missed connections for cruises, trip cancellations, medical emergencies requiring transportation/evacuation, baggage loss or delay, illness, job loss, change of plans, accidental death and disability, travel accident/sickness medical expenses, and more. Having appropriate insurance coverage can help mitigate financial losses in nearly all situations. It is important to note that without proper travel insurance, clients understand and agree that if they cancel or interrupt their travel for any reason, certain portions of the trip may not be refundable, and cancellation penalties imposed by Jill the Travel Gal and travel suppliers will apply, potentially resulting in the loss of funds up to the full cost of the travel booking and associated expenses. The purchase of travel insurance is not mandatory for other products or services offered by Jill the Travel Gal, but if clients choose not to purchase insurance, they will be required to sign an insurance waiver. Jill the Travel Gal is not a licensed insurance broker, and its advisors are not qualified or authorized to address technical inquiries regarding insurance benefits, exclusions, and conditions, or evaluate the sufficiency of existing insurance coverage held by prospective insured individuals. Additional charges will apply for selected travel insurance. Jill the Travel Gal cannot guarantee approval of coverage for any claims made under an insurer's policy, and makes no representations about the extent of coverage provided by any policy it may offer or quote.

FORCE MAJEURE

Jill the Travel Gal shall not be considered in violation of these terms and conditions or be held liable for any failure or delay in fulfilling an obligation under this Agreement if such failure or delay is caused by circumstances beyond its reasonable control. These circumstances may include acts of God, accidents, riots, war, terrorist acts, epidemics, pandemics, quarantine, civil commotion, breakdown of communication facilities (including web hosts and internet service providers), equipment malfunction, destruction or significant damage to facilities, natural disasters (such as extreme weather events, floods, and volcanic eruptions), governmental acts or omissions, changes in laws or regulations, national strikes, fires, explosions, scarcity of raw materials or energy, and any other unforeseen circumstances that are beyond the control of Jill the Travel Gal. It is highly recommended to purchase travel insurance for all trips.

Furthermore, each of Jill the Travel Gal's suppliers has its own terms and conditions that include provisions for Force Majeure events. In the event of a Force Majeure event, these suppliers may have the right, at their sole discretion, to modify, postpone, or cancel any itinerary or arrangement related to the trip. The decision to provide any refund to you due to non-performance of obligations under these circumstances will be solely determined by the supplier, in accordance with their policies. However, Jill the Travel Gal will make reasonable efforts to assist you in obtaining reimbursement whenever possible.

RESERVATION OF RIGHTS: CHANGES TO THESE TERMS

We retain the right to rectify any errors. In the case of a pricing error or omission, we retain the right to modify the pricing or rectify any other inaccuracies. All offers, incentives, and promotions from suppliers are subject to availability and may be subject to change without prior notice. Prospective clients are advised to make early reservations to avoid disappointment, potential fare increases, and additional fees for late bookings.

 GENERAL

The laws of the State of Ohio govern these terms and conditions and this agreement. The courts of Delaware County, Ohio shall have exclusive jurisdiction and venue in any and all disputes arising out of or relating to travel bookings with Jill the Travel Gal.

If any provisions of this agreement are held or determined to be invalid or unenforceable under present or future laws, such provisions shall be revised to implement, as closely as possible, the intention of the parties. If such revision is not possible, such provisions shall be fully severable and shall not invalidate the remainder of this agreement, which shall remain in full force and effect.

These Terms and Conditions (including any referenced terms and conditions) serve as the comprehensive agreement between the client and Jill the Travel Gal pertaining to travel bookings made through Jill the Travel Gal via any medium. They supersede all prior or concurrent communications and proposals, irrespective of whether they were communicated electronically, orally, or in written form, between the client and Jill the Travel Gal regarding their interactions with Jill the Travel Gal. A printed version of this agreement and any electronically provided notices will be deemed valid in legal or administrative proceedings related to these Terms and Conditions. They carry the same evidentiary weight and are subject to the same criteria as other business documents and records that were originally generated and maintained in printed format.
